TINJAUAN YURIDIS TERHADAP PEMALSUAN SURAT KENDARAAN BERMOTOR (Suatu Studi di Reskrim Umum Polda Sultra)

Abstract

The objectives of the study were: 1). To determine the factors that cause the occurrence of criminal acts of forgery of motor vehicle documents in Kendari City 2). To determine efforts to prevent the occurrence of criminal acts of forgery of motor vehicle documents. This study was conducted in Kendari, precisely in the General Criminal Investigation Unit of the Southeast Sulawesi Regional Police, using the type of research, namely normative empirical. The data collection method used was document study, field surveys and interviews using qualitative descriptive analysis. Based on the results of the study, it can be seen: 1). The factors causing forgery of motor vehicle documents are influenced by 2 (two) factors, namely; a). Internal factors, namely the personal condition of the perpetrator, for example an unhealthy mentality, uneducated and not appreciating religious values. b). External factors consist of; 1). environmental factors, and 2). poverty factors, the need and use of vehicles for the purposes of the flow of goods and people continues to increase, such conditions make vehicles as a means of transportation increasingly soaring in price, this in addition to having a positive impact, which can provide increased welfare and benefits for its owners also has a negative impact, namely the emergence of various cases and problems, especially crimes in the form of theft, and forgery of motor vehicle documents. 2. Efforts to prevent forgery of motor vehicle documents, namely: a). Preventive efforts, can be in the form of: 1). Information/Socialization. 2). Guidance and legal counseling to the community. b). Repressive efforts, can be in the form of: 1). Rehabilitation is carried out through education and coaching for suspects who are in detention. - In addition to re-education and special guidance, also trying to ensure that the environment where the community is located, helps create an atmosphere that allows the community to understand and comprehend and carry out their obligations and responsibilities. 2). Supervision in the form of patrols and places that are prone to crime.
